Na temelju članka 64. stavka 1. Zakona o zaštiti okoliša (“Narodne novine” br. 80/13, 153/13, 78/15, 12/18 i 118/18), članka 29. stavka 2. Uredbe o strateškoj procjeni utjecaja strategije, plana i programa na okoliš (“Narodne novine” br. 3/17), te članka 52. Statuta Grada Pregrade (“Službeni glasnik Krapinsko – zagorske županije” br. 6/13, 17/13, 16/18-pročišćeni tekst, 5/20, 8/21), po prethodno pribavljenom mišljenju Krapinsko – zagorske županije, Upravnog odjela za prostorno uređenje, gradnju i zaštitu okoliša, Klasa: 351-01/21-01-69, Urbroj: 2140/01-08-21-2 od 19. srpnja 2021. godine, Gradonačelnik Grada Pregrade dana 19.07.2021. godine, donio je slijedeću

o započinjanju postupka ocjene o potrebi provedbe strateške procjene utjecaja na okoliš II. Izmjena i dopuna Prostornog plana uređenja Grada Pregrade
Članak 1.
Donošenjem ove Odluke pokreće se postupak Ocjene o potrebi provedbe strateške procjene utjecaja na okoliš (dalje u teksu: postupak ocjene) II. Izmjena i dopuna Prostornog plana uređenja Grada Pregrade (dalje u tekstu: izmjena i dopuna PPUGP).
Članak 2.
Postupak ocjene provesti će Upravni odjel za financije i gospodarstvo Grada Pregrade (dalje u tekstu: Upravni odjel).
Članak 3.
Razlozi za pokretanje izmjena i dopuna PPUGP utvrđeni su prijedlogom Odluke o izradi II. izmjena i dopuna PPUGP (Klasa:350-01/21-01/05, Urbroj: 2214/01-01-21-2) od srpnja 2021. godine.
Odlukom o izradi utvrđeni su slijedeći ciljevi izrade izmjena i dopuna PPUGP:
usklađenje sa Zakonom o prostornom uređenju i drugim propisima i zakonima koji neposredno utječu na uređenje, korištenje i zaštitu prostora
analiza i redefiniranje granica građevinskih područja i namjena površina prema dostavljenim pojedinačnim zahtjevima fizičkih i pravnih osoba te provedenoj analizi prostornih mogućnosti
izmjene prema pojedinačnim zahtjevima javnopravnih tijela i građana u tijeku postupka
redefiniranje Odredbi za provedbu
Članak 4.
Radnje koje će se provesti u postupku ocjene provesti će se sukladno odredbama Zakona o zaštiti okoliša i Uredbe o strateškoj procjeni utjecaja strategije, plana i programa na okoliš i odredbama posebnim propisima redoslijedom iz Priloga I. ove Odluke.
U okviru postupka ocjene dostaviti će se i zahtjev Ministarstvu gospodarstva i održivog razvoja, Upravi za zaštitu prirode radi provođenja postupka prethodne ocjene prihvatljivosti za ekološku mrežu sukladno odredbama Zakona o zaštiti prirode (“Narodne novine” br. 80/13, 15/18 , 14/19, 127/19).
Članak 5.
Zahtjev za davanje mišljenja o potrebi strateške procjene izmjena i dopuna PPUGP dostaviti će Upravni odjel javnopravnim tijelima iz priloga II. ove Odluke u roku od osam dana od dana donošenja ove Odluke.
Javno pravna tijela ovisno o obuhvatu i drugim značajkama plana daju u roku od 30 dana od primitka ovog zahtjeva mišljenje o potrebi strateške procjene.
Članak 6.
Ova Odluka stupa na snagu danom donošenja, a objaviti će se u Službenom glasniku Krapinsko – zagorske županije i internetskoj stranici Grada Pregrade.

REDOSLIJED RADNJI KOJE ĆE SE PROVESTI U POSTUPKU OCJENE O POTREBI PROVEDBE STRATEŠKE PROCJENE UTJECAJA NA OKOLIŠ II. IZMJENA I DOPUNA PROSTORNOG PLANA UREĐENJA GRADA PREGRADE
Upravni odjel sukladno članku 21. Uredbe započinje postupak ocjene u roku od osam dana od donošenja ove Odluke.
Upravni odjel pribavlja mišljenja javnopravnih tijela tako što im uz zahtjev za davanje mišljenja o potrebi strateške procjene dostavlja ovu Odluku u kojoj su navedeni razlozi i ciljevi provedbe postupka te Odluku o izradi II. izmjena i dopuna Prostornog plana uređenja Grada Pregrade.
Na temelju kriterija za utvrđivanje vjerojatno značajnog utjecaja plana na okoliš, koji su navedeni u Prilogu III. Uredbe, javnopravna tijela ovisno o obuhvatu i drugim značajkama plana daju u roku od 30 dana od primitka zahtjeva mišljenje o potrebi strateške procjene.
Ukoliko Ministarstvo gospodarstva i održivog razvoja, Uprava za zaštitu prirode, ne isključi mogućnost negativnih utjecaja izmjene i dopune PPUGP na ciljeve očuvanja i cjelovitost područja ekološke mreže, daje obvezujuće mišljenje da je obvezna provedba glavne ocjene prihvatljivosti na ekološku mrežu, što znači da se obavezno provodi i postupak strateške procjene.
Prije donošenja odluke u postupku ocjene, kojom Grad Pregrada utvrđuje da je za izmjene i dopune PPUGP potrebno ili nije potrebno provesti postupak strateške procjene, Upravni odjel za financije i gospodarstvo Grada Pregrade je dužan o provedenom postupku ocjene pribaviti mišljenje Upravnog odjela za prostorno uređenje, gradnju i zaštitu okoliša Krapinsko – zagorske županije, pri čemu je obvezan dostaviti prijedlog Odluke i cjelovitu dokumentaciju iz postupka ocjene.
Nakon pribavljenog mišljenja Upravnog odjela za prostorno uređenje, gradnju i zaštitu okoliša Krapinsko – zagorske županije, ako se u postupku ocjene utvrdi da izmjene i dopune PPUGP mogu imati značajan utjecaj na okoliš, gradonačenik Grada Pregrade donosi Odluku o obvezi provedbe strateške procjene koja sadrži osobito bitne razloge zbog kojih je utvrđena potreba strateške procjene sukladno kriterijima iz Priloga III. Uredbe.
Ako se u postupku ocjene utvrdi da izmjene i dopune PPUGP nemaju vjerojatno značajan utjecaj na okoliš gradonačelnik Grada Pregrade donijeti će odluku da nije potrebno provesti stratešku procjenu. Takva odluka sadrži osobito osnovne podatke izmjena i dopuna PPUGP te obrazloženje razloga zbog kojih je utvrđeno da nije potrebno provesti stratešku procjenu sukladno kriterijima iz Priloga III. Uredbe.
O Odluci iz točke 7. informirati će se javnost sukladno odredbama Zakona o zaštiti okoliša, Uredbe o strateškoj procjeni utjecaja plana i programa na okoliš i Uredbe o informiranju i sudjelovanju javnosti i zainteresirane javnost u pitanju zaštite okoliša (“Narodne novine” br. 64/08) kojima se uređuje informiranje javnosti u pitanju zaštite okoliša.
